Malpractice occurs whenever a professional has some kind of obligation to a person or business. This obligation is usually spelled out in a contract between the two parties. For example, you may have a contract with an architect stating that he or she will design your company’s new location. He or she may be guilty of malpractice if he or she then commits one of the following acts:

  • Nonfeasance. This is the legal term for failure to complete an action that one is contractually obligated to do. An architect commits nonfeasance if he or she simply fails to turn in a finished product by the agreed-upon deadline.
  • Misfeasance. This term describes an incorrect or incomplete completion of a task. For example, if an architect turns in half-finished blueprints, or designs a building that does not meet previously established expectations, this is misfeasance.
  • Malfeasance. This is a rarer offense in which a professional deliberately causes harm to another party. If your architect is actually a corporate spy who is giving information to your competitors, that may qualify as malfeasance.
