Can I Be Fired For Filing A Workers Compensation Claim With My Employer

In Iowa, it’s not legal to terminate someone’s employment for threatening to file a workers’ compensation case. That does not mean that it does not happen. It does make the workers’ compensation case better because that is, under our law, an admission that the person can no longer do that job and therefore they have lost earning capacity. When that does happen, and it happens infrequency in my experience, but when it does happen I do refer those people to an experienced employment lawyer to work with me to help them get the benefits they are entitled to.
