Two Lawsuits Filed for Alleged Cyclospora Outbreak

Two lawsuits were filed against Darden Corporation and Taylor Fresh Foods, Inc., accusing the companies of negligence. The lawsuits, filed by Hiawatha resident Kelly Kunc and Joyce Nendza, state that the companies failed to provide food ingredients that were clean and safe for consumption and, therefore, are liable for serving a contaminated product.

Kunc alleges that after eating at an Olive Garden located at 367 Collins Toad NE in Cedar Rapids on June 5, she experienced fatigue, cramping, and diarrhea starting on June 12, causing her to seek medical attention at Mercy Medical Center. Kunc was diagnosed with cyclospora infection on July 9 after having her stool inspected on July 6 and was prescribed Bactrim. When she filed the lawsuit on Monday, August 5, she was still suffering from the infection.

Nebraska resident Joyce Nendza also filed her lawsuit on August 5.

Both victims seek to be compensated for medical expenses they incurred.
