The Massachusetts family of a 4-year-old boy who died after falling from the escalator at the Sears Department Store at Auburn Mall filed a lawsuit against the mall last week.
On March 11, the boy was with his mother at the mall when he fell 18 feet through a gap in an escalator onto a glass display case. The boy was rushed to the University of Massachusetts Medical Center where he was pronounced dead a short time later.
The family is suing Sears, Roebuck & Co., Simon Property Group Inc., Schindler Elevator Corporation, and Botany Bay Construction. They are seeking an undisclosed amount in damages. The family is hoping that this lawsuit will prevent future escalator deaths from occurring.
