Man alleges he was pistol whipped by police officer

A man from South Dakota filed a lawsuit in August against the Iowa Department of Transportation. The lawsuit alleges that a Department of Transportation enforcement officer pistol-whipped the man. 

The lawsuit also names the Iowa Attorney General's Office as a defendant. However, the Attorney General said his office is likely immune from the claims. 

The alleged victim, David Howard, said he was pistol-whipped four years ago, and his lawsuit damages for negligence, assault, and battery.
