What is an intentional misuse defense?

|

Most products come with instructions and warnings that inform the consumer about proper uses. For instance, a microwave will often include instructions on which items are suitable for heating up.

If a consumer follows instructions but still incurs an injury while using the product, then that consumer will likely have a reasonable personal injury claim.

If, on the other hand, the user understands how to properly use the product but intentionally misuses it anyway, then that person likely will not win a product liability case.

In a product liability case, the plaintiff will likely need to show that the injury was not a result of intentional misuse, while the defense will often attempt to prove intentional misuse.
